At the Law Offices of Bruce C.F. McArthur, my legal practice is focused heavily on the handling of claims involving two kinds of damage: (1) residential fire damage claims and (2) residential water damage claims.
Fire Damage Claims
I represent homeowners who have had a residential fire (though I also represent property owners with small commercial fires). Even what appears to be a relatively small residential fire can be much more serious than initially expected. Residential fires involve direct fire damage to all or some portion of a home, condo, townhome, apartment or other dwelling. Typically, however, there is additional damage to the structure caused by the heat of the fire, by the smoke and by water. Frequently, there is additional damage that results from the fire-fighting process (e.g., doors or windows broken out to permit entry during a fire, or holes cut into roofs or walls as part of the firefighting process).
Homeowner’s Insurance
The usual source of payment for fire repairs is a homeowners insurance policy, a contract between a homeowner and his/her insurance company (“insurer”), which covers the cost of fire repairs to a home, and usually also covers replacement of a home’s contents (furniture, appliances and other personal belongings).
However, each insurance policy is different; each contains its own monetary limits and deductibles, including its own terms, conditions, limitations and exclusions. These policy provisions can play a major role in the adjustment of a claim for fire damage by limiting what an insurer is obligated to pay for your loss.

Water Damage Claims
This office also represents homeowners whose homes have suffered serious water damage. Such losses typically arise from plumbing leaks, water line ruptures or occasionally from other causes, such as serious roof leaks -- anything that can result in sudden and massive intrusion of water into the interior of a home.
This office does not address relatively small water leaks with minimal damage, particularly where the amount of damage likely falls within the jurisdiction of the Small Claims Court (under $7500).
Since all fire claims involve some degree of water damage, there is a large overlap between the kinds of issues that arise on fire damage claims and water damage claims.
