Sometimes insurance claims are denied. Sometimes these denials are proper and reasonable. Sometimes, however, the denial of a claim can be both improper and unreasonable.
A claim can be denied for many reasons. Sometimes, for example, a claim can be denied based upon a claims adjuster's suspicion that the insured is guilty of arson, or some other variety of fraud. Sometimes, a claim can be denied based on the application of an exclusion or other limiting condition in a homeowners policy, which limits or eliminates coverage. There can be many other reasons.
If you believe that your claim has been improperly or unfairly denied, or you do not understand your policy or your legal rights well enough to know if the denial is proper or fair, call me and come in for a free consultation. I will explore the situation with you and tell you whether or not I think I can be of assistance. I have, from time to time, represented families or individuals whose claims have been denied based upon a suspicion of fraud and/or arson, where in my opinion the suspicion was inappropriate or unfounded. I have also, from time to time, represented families or individuals whose claims were denied, based on the application of an exclusion in their insurance policy, where in my opinion, the insurance company's interpretation or application of the policy's language was wrong, or where I concluded the operative policy language was ambiguous.
If your claim has been denied, or you think it may be denied, call me and schedule a free consultation to talk about your situation, and your options.
